DOG WALKING SERVICE AGREEMENT
The parties to this agreement are: The dog owner, hereinafter referred to as ‘the Owner’ AND Alishah Watson, trading as Brisbane Trail Dogs, Business Address: PO Box 3159, Newstead, Queensland, 4006(hereinafter referred to as “the Walker”).
Whereas the Owner wishes to engage the Walker and the Walker agrees to undertake the services under the terms and provisions defined in this Dog Walking Service Agreement as well as the Owner & Pet Information sheet, which is attached to, and shall form part of this Agreement. Any reference to dogs in this Agreement shall refer to those specified on the Owner & Pet Information sheet.

General
The parties to this agreement are: The dog owner, hereinafter referred to as ‘the Owner’ AND Alishah Watson, trading as Brisbane Trail Dogs, Business Address: PO Box 3159, Newstead, Queensland, 4006(hereinafter referred to as “the Walker”).
Whereas the Owner wishes to engage the Walker and the Walker agrees to undertake the services under the terms and provisions defined in this Dog Walking Service Agreement as well as the Owner & Pet Information sheet, which is attached to, and shall form part of this Agreement. Any reference to dogs in this Agreement shall refer to those specified on the Owner & Pet Information sheet.
- Relationship and Responsibilities
- Following a (free) Meet & Greet session, the Walker will pick up the dog, transport it to a walking destination, exercise the dog for a minimum 60 minutes duration, and return the dog home. Private walks/jogs may begin at the Owner’s house, as arranged with the Walker.
- Dog exercise sessions will proceed in light rain unless the Owner requests otherwise. In the event of heavy rain, or weather deemed dangerous in the reasonable opinion of the Walker (eg storms, high temperatures), the exercise session will be cancelled. In the event of a cancellation of this nature the Owner may arrange a make-up session where vacant spots exist, to be taken during the same month. The Owner is free to request a session be cancelled for the same reasons, and may opt for a make-up session where vacant spots exist, to be taken within the same month. The onus is on the Owner to arrange make-up sessions.
- The Walker will perform the agreed-on services in an attentive, reliable and caring manner and the Owner agrees to provide all necessary information to assist in this performance.
- The Walker agrees to notify the Owner of any occurrence pertaining to the dog which may be relevant to the care and well-being of the dog.
- The Owner attests that the dog is socialised and easily controllable. The Walker reserves the right to refuse dogs that pull excessively on a lead, display aggressive or excessive resource guarding behaviour, lack basic obedience skills, or behave in a manner that will cause discomfort or harm to dogs or humans during the session.
- The Owner will ensure the dog is quick and easy to access for the Walker. Should the dog not be easy to access, or the dog not home, the Owner forfeits the walk.
- The Walker reserves the right to walk other compatible dogs at the same time (for group exercise bookings).
- The Owner will provide a suitable collar that fits the dog without risk of the dog pulling out of it, and a harness where required. The Walker will supply a suitable lead and waste bags.
- 1The Walker shall not be obliged to perform any other duties except those specified in 1.1
- The Walker shall be paid an upfront monthly fee upon issue of an invoice.
- A minimum booking of four sessions is required.
- Either party may terminate this Dog Walking Agreement a minimum of 48 (forty eight) hours prior to the first scheduled visit without incurring penalties or damages.
- Cancellation by the Owner of scheduled walks with less than two week’s notice may be charged at the full rate or rescheduled at the discretion of the Walker.
- Where the Walker as sole proprietor needs to cancel a scheduled walk due to unforeseen circumstances, he/she may offer a make-up session, provide a refund, or appoint a substitute Walker with the written approval of the Owner and any difference in the fees charged shall be for the account of the Walker.
- In the event of heavy rain, or dangerous weather such as storms or high temperatures, the exercise session will be cancelled. In the event of a cancellation of this nature the Owner has the option of arranging a make-up session where vacant spots exist, to be taken within the same month.
- Should any dog behave aggressively, dangerously or unco-operatively in reasonable opinion of the Walker, the Walker may terminate this Agreement with immediate effect.
- Should the dog be difficult to access from the Owner’s property in a timely manner, the exercise session will be forfeited.
- Any wrongful or misleading information in the Owner & Pet Information sheet may constitute a breach of terms of this Agreement and be grounds for instant termination thereof.
- Termination under the circumstances described in 3.2, 3.4, 3.5 or 3.6 above shall not entitle the Owner to any refunds nor relief of any outstanding payments due
- The Walker will carry liability insurance relative to the services performed for the Owner. A copy of the insurance policy will be made available to the Owner on request.
- The Walker accepts no liability for any breach of security or loss of or damage to the Owner’s property if any other person has access to the property during the term of this agreement.
- The Walker accepts no liability for any mishap which may befall the dog/s or be caused by the dog/s at the Owner’s property before the Walker arrives or after the Walker leaves the property following an exercise session.
- The Owner shall be liable for all medical expenses and damages resulting from an injury to the Walker caused by the dog.
- The Owner shall be liable for any damages or injuries caused by the dog while under the care of the Walker.
- The Walker accepts no liability for injury to the dog caused by animals or people outside of the Walker’s control.
- The Walker accepts no liability for harm caused by ticks and snake bites, and recommends that vigilant and regular tick prevention measures are undertaken by the Owner.
- The Walker is released from all liability related to transporting the dog to and from any veterinary clinic for first aid treatment, the medical treatment of the dog and the expense thereof.
- The parties agree to indemnify and hold harmless each other as well as respective employees and assigns from any and all claims arising from either party’s negligent conduct.
- In the event of an emergency, the Walker shall take all reasonable steps to contact the Owner at the numbers provided to confirm the Owner’s choice of action. If the Owner cannot be reached quickly, the Walker is authorised to:
- Transport the dog to the listed veterinarian;
- In the event the listed veterinarian is unable to accept your dog then the Walker reserves the right to take your dog to our memorandum of understanding partner at Newstead Vets. A copy of the Memorandum of Understanding will be made available to the Owner on request.
- Request on-site first aid treatment from the listed veterinarian in the first instance and if they are not available from our memorandum of understanding veterinarian
- Transport the dog to an emergency veterinarian clinic, or other veterinarian if the previous two options are not feasible.
- The Walker agrees to keep safe and confidential all keys, remote control entry devices, and access codes belonging to the Owner and to return same to the Owner at the end of the Agreement period or immediately upon demand.
- No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this Agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.
- This Dog Walking Service Agreement and Owner & Pet Information sheet constitute the sole and entire agreement between the parties with regard to the subject matter hereof and the parties waive the right to rely on any alleged expressed or implied provision not contained therein. Any alteration to this Agreement must be in writing and signed by both parties.
- The parties agree that any or all parts of this Agreement may be submitted to the other party in legible and recordable electronic form and upon acknowledgement of receipt by the receiving party shall become valid parts of the Agreement.
- Where appropriate words signifying the singular shall include the plural and vice versa.
- The Owner acknowledges that photos or video of the dog may be used for marketing purposes.
